Auction and Quick Sale of Birds


Auction:     Saturday, May 23, 2009


Civic Centre Theatre


Auctioneer, Mr Alan Ryder


Viewing from 10.00 a.m. - Auction at 2.00 p.m.


Breeders offering birds include: Alan Rowe, Sheppard & Flanagan, John McAllister, Geoff Tonkin, Peter Thurn, Mark Chidel, Blair & Poole, Peter Tirant, Ken Dunk, Brett& Danny Card, Rob Lucas, Wally Capper, Henry George, Garry Armstrong, Heath Chasemore, Ian Hunter

  Bids may be made prior to the auction in writing. They should be sent to the Sale Manager, Alistair Home, 2/138 Melville St Hobart and must reach him by Wednesday, May 20, 2009. The envelope should be marked "Auction" and will be passed to the auctioneer unopened. The auctioneer will bid on behalf of the absent bidders during the auction, clearly indicating when he is doing so.


AUCTION - RULES. TERMS AND CONDITIONS



1.         The highest bidder shall be the purchaser, and in the event of any dispute arising, the lot in dispute shall be put up again and the Auctioneer's decision shall be final.


2.         No party will be allowed to retract his or her bid after it is once taken by the Auctioneer.


3.         Prior to commencement of the Auction each intended bidder shall complete the registration book with his name, address, telephone number and signature and shall receive an Auction Buyers Bid Number. On the fall of the hammer the Purchaser shall give to the Auctioneer his bid number. In default, the lot purchased may, at the Auctioneers absolute discretion, be immediately put up again and resold.


4.         The Purchaser and the Vendor authorise the Auctioneer and/or his assistant to sign on their behalf the sale book, which with these conditions shall, except as otherwise provided by State or Federal Law, constitute the whole contract between the Vendor and the Purchaser to the exclusion of everything else.


5.         On the fall of the hammer each lot shall be at the Purchasers risk and expense and the sale price shall be paid for in cash immediately on conclusion of the sale. Personal cheques will be accepted by prior arrangement only. Until payment in full of the purchase money is made, property in the lot shall not pass to the Purchaser.



6.         All statements in the catalogue or advertisements as to sex, color, variety, origin, age, genuineness etc. have been prepared from information supplied by vendors and from visual inspection. However, such information shall not be relied upon as statements or representations of fact. INTENDING PURCHASERS MUST SATISFY THEMSELVES AS TO THE SEX, COLOUR, VARIETY, ORIGIN, AGE GENUINENESS AND CONDITION OF ANY LOT IN WHICH THEY MAY BE INTERESTED.


7.         The VENDORS and the AUCTIONEER are not responsible for any faults or defects in any lot.


8.         Except to the extent otherwise provided by State or Federal Law, the terms and conditions set out in this document are the only terms and conditions which apply in respect of the sale of any lot and all implied conditions or warranties, statutory or otherwise are hereby expressly negated. The Buyer's taking delivery of the birds shall be conclusive evidence that the birds are in satisfactory order and condition and fit for the purpose for which they are required.


9.         To prevent inaccuracy in delivery, no lot can be removed during time of sale, unless with the specific agreement of the Vendor. All lots must be removed at the completion of the sale or as specified at the time of the sale.


10.       The registration book must be completed and signed before entry to the Auction and inspection area. Any person, who chooses not to comply with any and all of these auction conditions and requests on behalf of the Vendor, will be respectfully denied entry to the Auction. This does not however apply to persons who are relatives, e.g. wife, children, etc., accompanying a registered bidder.


11.       Carrying cages will not be allowed into the main body of the Auction area until the conclusion of the Auction. Carrying cages, clearly marked with the Owners name, may be placed in a pre-arranged part of the area for collection after conclusion of the Auction.


12.       The birds must not be interfered with or subjected to judging sticks pens or similar objects.


13.       All lots will be submitted in the order in which they appear in the catalogue. However, if necessary the Vendor reserves the right to make any alterations to this order.


14.       Each lot will be sold to the highest bidder. All bidders must ensure that their bids are made in a clear, definite and decisive manner such as holding up their bid card and calling out their bid. It is not recommended that a nod of the head or a wink of the eye be relied upon to catch the Auctioneer's attention for a bid. All bidders must ensure that their bids are correctly acknowledged by the Auctioneer.


15.       At the fall of the hammer for each lot, the successful purchaser will be required to advise the Auctioneer of his bid number. An invoice will immediately be prepared for that person for that purchase and will be handed to the purchaser. This invoice will be required to be produced when paying for the purchase at the end of the auction.


16.       At the end of the Auction each purchaser shall proceed to the payment table where he/she shall hand over the purchase price and be given a receipt. This receipt will be required to be produced for the collection of the bird/s purchased.

Braddon Hall and Foyer


Many of the breeders offering birds for sale by auction have also provided birds for the Quick Sale. In addition prominent Tasmanian breeders are also offering birds for sale.

Management of the quick sale

-          The birds will be caged two to a cage on the morning of Sunday, May 24 and put on display in the bird viewing area at 10am. On completion of the sale they will be returned to the secure area for collection.

-          The sale of birds will commence at 2pm on the Sunday.

-          Between 10 am and 2 pm prospective purchasers may draw a buyer's number. The sale of birds will conducted in order of the numbers drawn. That is, the drawer of No 1 will have the first opportunity to buy birds, the drawer of No 2 will be second and so on.

-          Purchasers will be limited to purchase of two birds at a time.

-          A list of the birds for sale will be displayed prominently.

-          By 2pm buyers should have made their selection from the birds offered. Note that although the birds are caged two to a cage they may be selected individually. The birds are not offered for sale as pairs.

-          At 2pm drawer No 1 will be called on to nominate their purchase. The sale will be recorded immediately and drawer No 2 will be called on to nominate.

-          The call will continue until all birds are sold or all drawn numbers have been called.

-          If a drawer does not wish to exercise their option to purchase they may pass when their number is called.

-          If a drawer fails to respond when the number is called the number will be called again. Failure to respond at this stage will be taken to mean that the drawer has passed on their option to purchase.

-          Birds not sold at the completion of this process will remain for sale until 3pm.  These birds may be purchased on a first come first served basis with no limit on the number claimed..

-          Birds not sold by 3pm may be offered for sale by offer with the consent of their owner or will return to the custody of their owner.

-          Payment for the birds should be made promptly on the day of the sale.

-          A receipt will be issued for the purchased birds.

-          Purchased birds may be collected from the holding room on presentation of a receipt as soon as all phases of the sale are complete.
